The thing is that I feel bad for IV when people start screaming and yelling at them. IV is not responsible for passing these legislation. They don't even realize that if there was no IV, July fiasco would have resulted in lot of people not getting their 485 filed. So many people would have so far not been able to use AC21 and change jobs. They are just sitting and posting out their suggestions. IV needs members who can help them in their cause and strengthen the organization. They have no right to yell or scream despite not even contributing a single minute to the cause. I still believe that we better have couple of members who we know and can count to volunteer rather than a blog where people throw fancy suggestions and vent out. That is the reason for me being advocating for paid site. If not paid, then activate membership through state chapters. Have state leadership activate their membership based on their contribution for this blog. At least we know that they are contributing to the cause by money or time. I am seriously disgusted by seeing so many irrelevant postings on this site which has nothing to do with immigration and people spending hours blogging, rather than contributing couple of minutes with their state chapters.

Prior EAD expiring: 09/02/08
EAD renewal mailed: June 01/08.
Renewal confirmation email: July 17th.
EAD cards received by lawyer: July 19th
EAD valid from: 09/08 - 09/10

I am really surprised that you guys are contemplating on going against your employer for a employment letter and filing your GC. I mean, how hard is it for you guys to agree to the terms of your employer that you will work till you get your GC and upto 6 months beyond that..
If you guys came before 2001-2002 and seen how the situation was for green card filers you will now what I am talking about..
1. There was no concurrent filing of I-140/485
2. There was no premium processing for Labor
3. There was no premium processing for I-140
4. There was no AC-21, so there is no way of switching jobs..
Still it used to take 4-5 years to get a GC.
And you guys are complaining about your employer because you worked for 1-2 years and you want to quit as soon as you get EAD..
Just imagine what would have happened if the dates were not CURRENT.. How many more years you would have worked, cursing USCIS
Your greed will ruin you in future, just like you are cursing your employer's greed..
Also, before you curse your employer, it was you who joined the company and you had many months to find out what kind of employer you have and it quit the company long time back.. You could have switched to different company long time back..

Did you file I-140/I-485 concurrently. Where is employer's office location? and your residency?
I have filed I-140/I-485 concurrently on July 25th at Nebraska, my employer and my residence come under Texas Service centre according to new direct filing instructions.
I am in NJ and my employer too, and yes 140-485-765 concurrently..and I just checked the 140 file and it was updated 8-12-07...Do you guys think this is related to notices of action??? :confused:

I think both Attorney and we will get the receipts. By the way it may be too early to ask but can't control it .. any one got FP notice or EAD's?
Some months back two of my friends got EAD,FP Notice immediately.
If your case is at Texas you can dream about it. You will get FP in a month. Last I heard was EAD in 6 weeks. But you never know....:)

got approvals for wife and myself today
PD Jan 22 2006.
Infopass on Aug 3rd said everything is good to go.
opened SR no.1 for primary on aug 4th, was told cases were assigned on aug 3
Level 2 cust service said cases pre-adjudicated.
Reply to SR no.1 was standard - wait for 30 days.blah blah.
Congressman inquiry said cases assigned to officer.
opened SR no.2 for dependent on Aug 19.
i think the Aug 19 SR did the trick.

I think the answer is yes, we will get our EAD and AP.
USCIS only looks at your PD while they issue case number (when you file for 485) and next when they approve your case (they issue your GC)
they will issue an EAD and AP for all pending applications. EAD and AP don't need PD. as long as you have a case pending with USCIS you can get new/renewed EAD and AP

The answer is in your question. Numbers. A few years ago (circa 2002-) no one complained much about Indians. Recently the complaints in the media/forums etc. are much higher. Why ? More H1, => more bodyshoppers (mainly India) => more abuse => more complaints and so on.
Also FYI, H1 is "temporary" just like F1. H1 is not a guarantee to GC. So you need to go back after 6 years, since you say F1 should leave after graduation.

If many EB3-I folks are getting GCs then why is EB3-I PD stuck in 2001? Shouldn't it move?
I feel where you are coming from; I am also from the waited four years to get approved from filing 485 club.
btw; every person I know of from India who has gotten green from October 2008 were those eb3 guys who converted to eb2 through perm labor. I have a feeling that this is going to cause a lot of stress to eb2 as many people have been able to obtain old priority dates through eb3. Maybe not much solace but with perm labors taking 9 months to get approved now (most recent approvals were filed in July 2008) it does help India a bit. It is taking longer for eb2 ROW to get into 140/485 que and would cause more visas to be spilled over. If labors were getting approved fast then there would be less spillover in this fiscal year.
Department of State is really playing with people with their continuing change of how they are interpreting the law with regards to visa spillover. In Mid 90's I left USA (one of the reasons; not main reason was because I was told it would take about three years to get greencard; looks like a small wait compared to now).

Section 202 of the Immigration and Nationality Act (INA) states that the per-country limit for preference immigrants is set at 7% of the total annual employment-based preference limits. This means a country with large population like India and a tiny country like Lichtenstein get same number of visa numbers. This system is designed to systematically discriminate people from India and China by preventing them from attaining employment visas. More research needs to be done whether this constitutes a violation of US Equal Employment Opportunity Law. We need to find out whether this constitutes discrimination by national origin. I'm a july filer (July 16th)
have gotten EAD
Case status online says AP approved on Nov 2nd.
But NO FP.
Opened a SR on Oct 19th but don't have an appointment.
Called again yesterday and was told to call back on Nov 19th if I still don't have FP appointment.
Of the 6 filers at my job, only 2 got FP...very strange.
FYI, when I called the USCIS, they said it is very unusual not to get FP right after receipt notices. Apparently, the FP appointments are sent "automatically" after the receipts are generated/sent etc. That's what the USCIS rep told me anyways and she opened a SR on her own based on the info I gave her that my FP appointment hadn't arrived after over 100 days.

Well, it goes beyond that. This is a "complicated story with no sub titles".
IV website is a board where people of all kinds visit and there is no control over stuff. Just go to any blog site - we see 100 rants and crazy comments as against a few wise talk.
I guess we have to live with it and keep pushing people. Sometimes loud and sometimes gently.
My friend, it is to "push the people" that I am saying all this. How best can we push? Through word of mouth, or thru full campaign?
Another idea: How about restructuring the forums?
In the home page, we promote only those discussions that are important to all, like advocacy.
In next tab, we take on the discussions that are based on individual problems
And all else, can go to the third tab
Also on home page, the following items (just some examples of general interest matter):
- Advocacy day. Donations received vs required.
- Big red button: Donate
- Some links to recent news items on immigration
Home page should have text content that introduces IV, its activities, and a small lecture on why skilled immigration is important
