Shouldn't IV ammend the text of the email to better reflect the negative impact of the Bernie Sander's ammendment ? The Senators (who are known for not often reading voluminous legislation in detail) may have voted with their hearts for this ammendment thinking this was going to help students in their states. I think IV members who are their constituents should have a means of letting their Senators know the effect of their actions and for those who voted against it they should be congratulated for voting against this harmful ammendment. They may have thought of this as win-win situation. Yet they may have not known the following points (read the study its detailed):

If you have any emergency to go out of country or to change jobs, you can get your passport stamped by taking an Infopass appointment or you can request IO to upload the Biometrics to TSC. you will get the card in 10 or 15 business days after uploading the biometrics. either way your GC is approved..so no worries.
My answer is depending on my experience with GC.

I agree with you vin13, remove country quota or by number of years we are legally here in US.

You are in the EB3 category, do you ever wonder why somebody who is more educated than you or me, makes more money? Can we say, hey you I was born in 1890 I should make more money, it does not fly, EB3 is not a reflection on your skills but more the job you hold.
The question you should ask is why have EB1, 2, 3, etc?
Why do you not include the family based categories, isn't family first, why not the EB spill over to to FB first then whatever trickles down comes to EB, is not this fair? I am sure there are a lot in the FB queue who have waited for longer than you. Now dont tell you you are better than FB because you are highly skilled, pay taxes, etc.

Is it not true that you would need to invest 1 million or so to get the GC ?, i am EB 2 with PD July 09 (not approved yet), my options are, a) go back b) go back c) go back , so i guess we will wait for this CIR, if it does not pass, and if I am still here, then I am outta here :cool:

I also did the same thing. I got the scan copies from my lawyer. Print out will work (IO will verify yr name on receipt with yr photo Id).

I think it is around 13 or 14...if they are under that, USCIS only takes a thumb print
I don't think there is a specific age where they will taken finger prints. Read my story.
My 15 yr old was the first to receive the notice. She was not in US at that time. I called the USCIS and informed them about this. They said they will postpone the appointment. But the postponement was only for 2 weeks. With the next notice I went to the local office. The security officer gave me a print out stating that I visited there for this reason. AND ACCORDING TO THAT NOTICE, FINGER PRINTING CAN BE DONE WITHIN 64 DAYS FROM THE ORIGINAL NOTICE. My child came back to US in 60 days and I took her to the local office walk in date. He got finger printed.
The very next week my 9 yr old got the notice. I took another appointment and next day I got a second finer printing notice for my elder one again. I took both of them to the local office and explained the situation. For my second child they did the finger printing and for my elder, they made a stamp on to the latest notice which was not at all clear.
Me and wife was never requested for a second finger printing. We all just got GREENED on August 6th.

I guess it would have to be a pretty big and wild rally to have the police getting involved. :p
But Chandu raises an excellent point. There is much more to a rally than just turning up. Some one from core can probably help with detailed instructions.. these are just my thoughts.. feel free to add/correct.. (PS: I have zero experience in rallies, by the way)
First, I suppose checking with the local authorities and informing them of your plans, expected turnout, location, duration etc before anything else is a good idea. Bad idea to have have an unexpected crowd turn up randomly in a public place.
Organize placards, banners, podium, hand outs etc. Dont forget first aid kits, water.
Figure out who is going to be the spokesperson for the rally. Would be pretty silly if a reporter does come there and no one knows how to articulate well.
The spokesperson should check with core regarding message etc. This is important.
If there is critical mass for the rally, and the authorities are informed etc, then contact the local news and inform them as well..
Any other ideas/tips?

Please do a thorough research on how effective rallies are based on our situation. We do not have much political support - no government support, no public support - and not the least of sympathy though we contribute so much.
In case of unanticipated actions - we may never know if politically we will have any help fro higher ups.
Also - please check the numbers ( remember though a lot of people show enthusiasm in discussion forums, in reality you will find very less people taking part)
So please do your homework and do a lot of discussion. Do not hurry up and rush into rallies. A lot of rallies are done by disciplined leaders who plan these well in advance.
Please do some research.
Once again - it is nice to see the zeal in all the members to do something. Please contribute to IV. Participate in media drive and update information. Help in all posible ways. Please contact core to discuss strategies.

There is not such out of touch congressmen or further education needed to be done. Congressmen are well aware of the plight of legal immigrants way before than immigrationvoice.org dreamed of existence. We fought hard in order to educate congressmen and often their staff played dumb, but again the truth is that they never cared about our plight.
The reality is that this, as usual, is primarily driven by business needs. Major employers such as Bill Gates lobby mainly for H1B numbers increase. Employers are very much aware that H1B staff under pressure can put up and deliver the very long journey of 60-80h/week expected at Microsoft. Yes, Microsoft and many other major employers could easily find qualified US students with two years of experience, skills by the way comparable to what the vast majorities of H1B's offer, but Americans who do not need the H1B would give a finger to any employer who would expect that an American would work 80h/week for 55K/year. The "brighest and the best" out there, a typical individual on the mid 30's with 10+ year of experience, masters degree and tons of sweating and bleeding in the IT world, I am not sure whether Bill Gates want to open the wallet and pay more than $100K. They would prefer to outsource the work to China - not even India anymore. That is the reason and the only reason only which explains why wages have not increased to IT programmers in the last few years.
Illegal aliens are being backed by major employers of cheap labor, such as Wall Mart and many others. Illegals also can put extra long hours and therefore they yield more output for less investiment. That's is the reason that US employers seem to fight so consistently to keep them here. Since illegal aliens are in higher numbers and can deliver more not offshoreable productivity than us, so that is the reason why they are the ones getting the red carpet.
At this moment our incluence is minimal, if not not pathetic. As a matter of fact, I am afraid that more our category of workers fight and protest, more the American people will be outraged and scared and will react calling *their* congressmen even harder in order to push us all out.
For the naive and dreamers out there who are shaking their heads after reading the above and believe that the above is propaganda, so just think about it.

I am wondering how we ended up here. We have been doing this campaign for so long, we have now hired a lobbying firm, and we've met, called, emailed and faxed so many senators etc. How come this bill completely ignored, and in fact in some senses, hurt us?
I have seen posts about lawmakers being stupid, out-of-touch etc but I think these posts are mostly facetious. I feel troubled by the fact that in spite of numerous efforts the lawmakers decided to ignore us - and if this was India I would have attributed this to the fact that in us they don't (yet) have a vote bank.
Please take this post in a positive way and as a stimulus for some soul searching - why did we end up in this situation?

as per the attorney, the case history of employers who won using non competes in the court are very rare unless the law suit is agiainst key personnel and court gets convinced by the legitemate business interest. Thats good news. I think the attorney I met represents more of employers and so very reluctant on mine. I believe I still have hopes, I will look for a good attorney again to get mine reviewed.
as per the attorney, the case history of employers who won using non competes in the court are very rare unless the law suit is agiainst key personnel and court gets convinced by the legitemate business interest. If you have h4 stamp in your passport , you can go out of the country and comeback in and you would be back in h4 status. Short of that I don't see any other option. Ohers please chip in with your ideas.

The newsletter mentioned above was sent out to all members yesterday afternoon. Maybe some have turned off emails from IV, or it went to the spam folder.
I have received the news letter and it is pretty neat. But you know, many people are busy. So my suggestion was to send out another simple version with only the Advocacy day link with a request for contribution.
